Of the 20%(thousands) in family court each year, NH parents and their children will most likely experience the following without due process:

  • a protracted case fulfillment track

  • an artificially manufactured high conflict environment ​

  • child(ren) separation from at least one parent, their larger family unit one or more siblings, and their community

  • temporary/ex parte orders artificially create an 'absent' parent profile

  • the more nurturing and proactive parent becomes the absent parent, [an absent parent is required for Title IV-D funding for BCSS] 

  • case manipulation that attaches unnecessary services from BCSS, DCYF, YDC, Therapy, GAL, Investigators and HHS

  • a child support contract ordered, though not warranted or wanted, this activates enforcement actions through cooperative agreements

  • an incomprehensible court case that results in life-altering harm

Most all parents are unaware the entire family court system:

  • is not a court of law; it is a administrative court of deference

  • includes family court, BCSS, DCYF, and YDC, all reliant on taxpayer funds 

  • claims powers of executive and judicial branches; no separation of power

  • is financially incentivized by Federal Title IV-D [child support contracts]

  • operational funding relies on grants, incentives, billing, case length, and a business product or commodity [parents and child(ren)]

  • helps family legal service providers establish parent/child services billing

  • operates without the right to due process [not a court of law] 

  • does not apply the NH rules of evidence

  • overwhelmingly ignores 'best interest' standards for both parents and children [interpretation is subjective]

  • arbitrarily removes rights and freedoms without due process and take enforcement actions 

  • relies on the concept of 'right to appeal' as a fair redress after denying due process rights, best interest standards, fair and expedient justice procedures

  • negatively impacts families of all income levels, demographics and sizes

First in the Nation Bill:

Dismantle Family Court

HB652 Description:  Abolish the family division and restore due process in all proceedings. 

  • Create a new department of family mediation with oversight—the first stop option for separating couples.

  • Reinstate due process where fundamental rights and freedom.

  • Stop “conviction” and punishment without due process. Reassign the jurisdiction of cases involving civil or criminal matters to courts of law.

  • Acknowledges the courage of Family Court survivors.
